1. Acceptance of Terms
These Terms of Service (the "Terms" or "Agreement") constitute a legally binding agreement between you (the "User," "you," or "your") and Maccabi Olympus Archers Rehovot (the "Club," "we," "us," or "our") governing your access to and use of https://www.olympus-archery.com, together with any associated mobile applications, desktop applications, and related digital platforms (collectively, the "Service"). By accessing, browsing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.
2. Account Registration and Eligibility
Access to certain features and functionalities of the Service requires the creation of a registered user account. By creating an account, you represent, warrant, and agree that:
- All registration information you provide is truthful, accurate, current, and complete, including your full legal name in all required languages
- You will furnish any additional identification documentation as may be reasonably required in connection with membership enrollment and verification
- You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account
- You will promptly notify the Club of any known or suspected unauthorized access to, or use of, your account
- You accept full responsibility for all actions taken through your account, whether or not authorized by you
Individuals under the age of eighteen (18) may use the Service only with the express consent of, and under the supervision of, a parent or legal guardian who agrees to be bound by these Terms. The parent or guardian shall be responsible for the minor's compliance with these Terms and for all activities conducted through the minor's account.
3. Membership Terms and Conditions
Club membership is offered through various subscription plans as may be made available through the Service from time to time. By enrolling in a membership plan, you acknowledge and agree to the following:
- Membership plans, including their associated fees, billing frequencies, and benefits, are as described on the Service at the time of enrollment and may be subject to modification upon reasonable notice
- Certain membership plans may involve recurring periodic charges that are automatically billed to your designated payment method at the applicable billing interval unless and until cancelled in accordance with these Terms
- You may cancel your membership at any time through the account management features of the Service or by contacting the Club directly. Upon cancellation, your membership privileges shall remain in effect through the end of the then-current paid billing period
- Refund requests are subject to and governed by the applicable provisions of the Israeli Consumer Protection Law, 5741-1981. Refund eligibility, conditions, and applicable timeframes shall be determined in accordance with said statute
- In the event of a payment processing failure, the Club shall make reasonable efforts to notify you. Repeated payment failures may result in the suspension or termination of your membership privileges
- A receipt compliant with applicable Israeli tax and fiscal requirements shall be generated and made available to you for each completed transaction
4. Marketplace Terms
The Service may include a marketplace feature that enables users to list, advertise, and sell goods. Your use of the marketplace is subject to the following additional terms and conditions:
- Each seller is solely and exclusively responsible for the accuracy, completeness, and lawfulness of their listings, the condition and quality of the goods offered, and the fulfillment and completion of any resulting transactions
- The Club acts solely as a venue and facilitator. The Club does not participate in, guarantee, warrant, endorse, or assume any liability whatsoever with respect to any marketplace transaction or the goods listed therein
- Information you voluntarily include in a marketplace listing, including any contact details, shall be publicly accessible to all users of the Service and may be visible to the general public
- Listings for items that are prohibited under applicable Israeli law, including but not limited to unlicensed weapons, counterfeit merchandise, and controlled substances, are strictly prohibited
- The Club reserves the right, in its sole and absolute discretion, to remove, disable, or restrict any listing at any time, with or without notice, for any reason or for no reason
- The Club does not currently charge commissions, transaction fees, or listing fees in connection with marketplace transactions. The Club reserves the right to introduce such fees upon reasonable prior notice
5. Training Tools and Timing Features
The Service may include training tools, timing features, and other digital aids designed to assist in the conduct of practice sessions and related athletic activities (collectively, "Training Tools"). Training Tools are provided solely as informational and organizational aids and are not intended to serve as official competition instruments. The Club expressly disclaims any and all liability arising from or related to the accuracy, reliability, or availability of Training Tools. Official competition results, scores, and timing shall be determined exclusively by duly appointed officials and certified timing systems in accordance with the rules of the relevant governing body.
6. Acceptable Use Policy
You agree that you shall not, and shall not permit any third party to, use the Service in any manner that:
- Violates any applicable local, national, or international law, statute, regulation, or ordinance, including without limitation the laws of the State of Israel
- Infringes, misappropriates, or otherwise violates any intellectual property right, proprietary right, or right of publicity or privacy of any third party
- Involves the impersonation of any person or entity, or the false representation of your affiliation with any person, entity, or organization
- Involves the submission, posting, or transmission of any false, misleading, fraudulent, or deceptive content, including without limitation in marketplace listings
- Disrupts, interferes with, or degrades the experience of other users of the Service, including through the misuse of interactive, real-time, or communication features
- Involves any attempt to gain unauthorized access to any systems, networks, accounts, data, or information associated with the Service
- Interferes with, disrupts, damages, or places an unreasonable or disproportionate burden on the Service or its underlying infrastructure
- Involves the use of any automated means, including bots, scrapers, crawlers, or similar technologies, to access, monitor, or interact with the Service without the prior written consent of the Club
7. User-Generated Content
You retain all ownership rights in and to any content that you create, upload, submit, or otherwise make available through the Service ("User Content"). By submitting User Content to the Service, you hereby grant the Club a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such User Content in any and all media and distribution channels, solely as reasonably necessary to operate, maintain, improve, and provide the Service. This license shall terminate upon the deletion of the applicable User Content from the Service, subject to reasonable backup and archival periods.
You represent and warrant that you own or otherwise possess all rights, licenses, consents, and permissions necessary to grant the foregoing license and that your User Content does not violate these Terms, infringe upon any third-party rights, or contravene any applicable law. The Club reserves the right, but not the obligation, to review, monitor, and remove any User Content that, in its sole judgment, violates these Terms, is objectionable, or is otherwise inappropriate.
8. Intellectual Property Rights
The Service and all of its constituent elements, including but not limited to the overall design, layout, look and feel, graphics, logos, trademarks, service marks, text, software, source code, and all other content and materials provided by the Club (collectively, "Club Content"), are the exclusive property of Maccabi Olympus Archery or its licensors and are protected by applicable Israeli and international intellectual property laws, including copyright, trademark, patent, and trade secret laws. No right, title, or interest in any Club Content is transferred to you by virtue of your use of the Service. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Club Content without the prior express written consent of the Club.
9. Payments, Billing, and Taxes
All fees associated with the Service are denominated in New Israeli Shekels (NIS/₪) and are processed through our authorized third-party payment processors. By purchasing any paid features of the Service, you agree to the following:
- You authorize the applicable third-party payment processor to charge your designated payment method for the fees associated with your selected plan or purchase, at the intervals and in the amounts specified at the time of enrollment or purchase
- All stated fees are inclusive of Value Added Tax (VAT) to the extent applicable under Israeli law. You are solely responsible for any additional taxes, duties, or levies that may be imposed by your jurisdiction of residence
- Recurring subscription plans shall automatically renew at the end of each billing period unless you cancel prior to the commencement of the next renewal period
- Your rights as a consumer are protected under the Israeli Consumer Protection Law, 5741-1981, and nothing in these Terms shall be construed as limiting or waiving any rights afforded to you thereunder
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. THE CLUB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, IN WHICH CASE THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ISRAELI LAW, IN NO EVENT SHALL MACCABI OLYMPUS ARCHERY, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, COACHES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THE CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to defend, indemnify, and hold harmless Maccabi Olympus Archery and its officers, directors, employees, volunteers, coaches, agents, successors, and assigns from and against any and all claims, actions, proceedings, demands, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of any third party.
13. Termination and Suspension
The Club reserves the right to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and for any reason, including without limitation for conduct that the Club reasonably believes violates these Terms, is harmful to other users or the Club, or is otherwise objectionable. In the event of termination due to prolonged non-payment of applicable fees, the Club may terminate your membership following a period of not less than sixty (60) days of outstanding obligations. Upon termination, you shall have a period of thirty (30) calendar days to retrieve or download any personal data or User Content from the Service, after which such data may be permanently deleted in accordance with our data retention practices.
14. Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the substantive and procedural laws of the State of Israel, without regard to its principles of conflicts of law. The parties agree that, prior to initiating any formal legal proceedings, they shall first attempt to resolve any dispute through good-faith negotiation for a period of not less than thirty (30) days following written notice of the dispute. Any legal action or proceeding not resolved through negotiation shall be brought exclusively before the competent courts located in the city of Rehovot, Israel, and each party hereby irrevocably consents to the personal jurisdiction of such courts.
15. Modifications to These Terms
The Club reserves the right to modify, amend, supplement, or replace these Terms at any time, at its sole discretion. In the event of material changes to these Terms, the Club will endeavor to provide reasonable prior notice by posting the revised Terms on the Service with an updated effective date and, where circumstances warrant, through additional notification via the Service or electronic communication. Your continued access to or use of the Service following the effective date of any modified Terms shall constitute your binding acceptance of such modifications. If you do not agree to any amended Terms, your sole and exclusive remedy is to discontinue use of the Service.
